Under regulation 20FC of the
Renewable Energy (Electricity) Regulations 2001, the nominated person for a power station may apply to have the 2008 waste coal mine gas limit redistributed between two or more power stations.
A nominated person may also apply to have the 2008 waste coal mine gas limit varied for a year for an accredited power station under Section 30G of the
Renewable Energy (Electricity) Act 2000 and Regulation 20FC.
The application for the redistribution of 2008 waste coal mine gas limits between accredited power stations form must be completed and lodged with the Clean Energy Regulator no later than 30 September before the year the 2008 waste coal mine gas limit may be varied. All applications must include:
- the power station/s and proposed changes to the 2008 waste coal mine gas limits
- a statement explaining the reasons why the variation should be made, and
- any other information the nominated person considers relevant.
Refer to Regulation 20 FB (3) for more information on the application. This form can be used to apply to vary the 2008 waste coal mine gas limit for year 2015 onwards.
The Clean Energy Regulator may vary the 2008 waste coal mine gas limit for a year for two or more accredited power stations if:
- the application is submitted by the nominated person as set out in Regulation 20FB (3)
- at least one large-scale generation certificate (LGC) was created in relation to electricity generated by each power station using waste coal mine gas, and
- after considering the applications, the Clean Energy Regulator considered the 2008 waste coal mine gas limits should be varied for the year.
The redistribution of the 2008 waste coal mine gas limit for 2016 between accredited power stations
The Clean Energy Regulator has made a determination under Regulation 20FC to vary the 2008 waste coal mine gas limits for 2016. The determination has been made for accredited power stations that applied for the redistribution of 2008 waste coal mine gas limits between accredited power stations.
The 2008 limits for the waste coal mine gas power stations accredited under the Large-scale Renewable Energy Target for 2016 are now determined to be:

Under section 66 of the Act, a determination varying the 2008 waste coal mine gas limit for an accredited power station is a reviewable decision. Requests to reconsider the decision must be made in writing to the Clean Energy Regulator within 60 days of the decision.
