NGER legislation changes for 2016-17 reporting

​Regulations

The National Greenhouse and Energy Reporting Regulations 2008 (the Regulations) have been updated for 2016–17 onwards. Amendments include:
  • The requirement to list the addresses of each small facility has been replaced by a requirement to report only the number of small facilities aggregated by the reporter.
  • References to ‘greenhouse gas substances’ have been replaced with references to ‘greenhouse gases’.
  • Reporting of emissions from the combustion of international bunker fuels (fuels used in shipping) for transport have been excluded.
  • Reporting of small electricity generating units has been clarified to reduce reporting burden, particularly for reporters with back-up electricity generation.
  • Reporting of electricity for use other than for supply to the main grid has been amended to clarify that electricity produced for supply to grids other than the main electricity grid is considered ‘supply to an electricity transmission or distribution network’.

Measurement Determination

The National Greenhouse and Energy Reporting (Measurement) Determination 2008 ​(Measurement Determination) has been updated for 2016–17 onwards. Amendments include:
  • Minor technical corrections have been applied to methods for the estimation of fugitive emissions from coal seam gas operations, energy, municipal solid waste and some industrial processes.
  • Provisions for estimation of emissions from legacy waste at landfills have been reinserted to support the NGER (Safeguard Mechanism) Rule. 
  • Additional methods concerned with carbon capture and storage (CCS) activities have been finalised. 
  • Scope 2 emission factors have been updated to reflect changes within the National Electricity Market in the last financial year.

Technical guidelines

The National Greenhouse and Energy Reporting Technical Guidelines​ for 2012–13, 2013–14, 2014–15, 2015–16 and 2016–17 financial years are available on the Department of the Environment and Energy website to assist stakeholders in understanding and applying the Measurement Determination.
