Compliance with the Information Publication Scheme Agency Plan is an ongoing statutory responsibility for agencies subject to the Freedom of Information Act 1982 (FOI Act). It requires agencies to take a proactive approach to publishing information.

Under the IPS an agency must prepare a plan showing:

• what information we propose to publish
• how and to whom we propose to publish information
• how we otherwise propose to comply with the requirements of Part II of the FOI Act.

What Information we will publish

The Clean Energy Regulator will publish the following classes of information:

• details of our organisational structure
• details of our functions including our decision-making powers and other powers affecting our clients
• our annual reports
• details of the arrangements for you to comment on specific proposals for which we are responsible, including how and to whom those comments may be made;
• information in documents to which we routinely give access in response to requests under Part III of the FOI Act except:
  • personal information about any individual the publishing of which would be unreasonable
    
  • information about the business, commercial, financial or professional affairs of any person the publishing of which would be unreasonable,
  • other information of a kind determined by the Information Commissioner the publishing of which would be unreasonable.
• contact details of an officer who can be contacted about access to information or documents held by us;
• our operational information – that is, information held by us for the purpose of performing or exercising our functions and powers in making decisions or recommendations affecting our clients.

How we will publish information

This information will be published on our website. In accordance with the requirement of subsection 8D(3) of the FOI Act the information will be available:

• for download from our website, or
• by following other published details of how the information may be obtained.

Other requirements of Part II of the FOI Act

The Clean Energy Regulator will comply with the other requirements of Part II of the FOI Act as follows:

• We will have regard to any guidelines issued by the Information Commissioner under section 93A of the FOI Act.
• in performing a function or exercising a power under Part II of the FOI Act, we will also have regard to the objects of the FOI Act as set out in sections 3 and 3A.
• We will cooperate with any review of our handling of the publication scheme carried out by the Information Commissioner.
• We will comply with the requirement in subsection 10(2) of the FOI Act in relation to the application of any rule, guideline or practice in the unpublished information.
• The Agency will review the operation of its IPS from time to time, in accordance with the guidelines issued by the Information Commissioner about IPS compliance review.
