An enforceable undertaking is deemed to be complete when all tasks offered by a party are accepted by the Clean Energy Regulator and have been completed to our satisfaction.

CircumstancesIt is alleged that GT Trade Solutions Pty Ltd breached s.24B(1) of the Renewable Energy (Electricity) Act 2000 by providing false and misleading information to a second person, with the expectation that the second person would rely on this information to create certificates.
This false and misleading information related to the incorrect recording of installer details and signatures for 212 installations and as a result, certificates were improperly created.
Undertaking​​​​

GT Trade Solutions undertakes to, by 5 pm on the 30 April 2015:

  • Arrange for an accredited CEC installer to return to each installation address listed in the Schedule to re-inspect the solar PV system to ensure the system is compliant with the CEC guidelines and all state and local requirements; and
  • Provide photos of each reinspected installation; and
  • Upon completion of the inspections, provide the Regulator with a statutory declaration, prepared by the CEC installer who carried out the re-inspections, stating time and date the systems were reinspected and that they meet CEC guidelines and all state and local requirements.
  • Provide information, as requested, on a weekly basis.

Inspections must only be undertaken with the approval of the system owner and resident.

In the event that one or more system owners or residents cannot be contacted or do not wish to allow a re-inspection GT Trade Solutions also undertakes to provide to the Regulator a statutory declaration, prepared by the GT Trade Solutions director, listing all such system owners and residents, with a declaration that all reasonable steps have been made to contact them and offer them a re-inspection.

Circumstances

It is alleged that Solar Storage Pty Ltd breached subsection 24B (1) of the Renewable Energy (Electricity) Act 2000 by providing false and misleading information to a second person, with the expectation that the second person would rely on that information to create certificates.

The second person did in fact rely on that false information, and, as a result, created certificates for 109 installations which they were not entitled to create.

Undertaking

Solar Storage Pty Ltd undertakes to, on or before 31 May 2014, have an independent Clean Energy Council accredited installer return to each installation site identified by the Clean Energy Regulator to inspect the installed PV system.

Upon completion of the inspections, Solar Storage undertakes to provide the Regulator with a statutory declaration, made by the CEC installer(s) who carried out the re-inspections, that the PV installations and electrical work meet the requirements for the issue of certificates.

Inspections must only be undertaken with the approval of the system owner or resident.
