Consultation now open on draft amendments to Renewable Energy Target regulations

​The Department of the Environment and Energy (the Department) has opened public consultation on draft legislation to amend the Renewable Energy (Electricity) Regulations 2001 to clarify:
  • the eligibility of small generation units, and
  • the audit requirements for applications to amend exemption certificates.

The Department is seeking views on the following draft legislative instrument – Renewable Energy (Electricity) Amendment (Small-scale Solar Eligibility and Other Measures) Regulations 2019.

This package of amendments will not affect the current level of support provided to households and businesses to install solar PV systems under the Small-scale Renewable Energy Scheme.

These amendments will:

  • clarify how the boundary of a solar PV device should be determined (generally consistent with our existing guidance) and to add new anti-gaming provisions to prevent large-scale solar projects from participating in the Small-scale Renewable Energy Scheme instead of the Large-scale Renewable Energy Target, and
  • require an audit report to accompany an application to amend exemption certificates where there has been a material change in the way the use method is calculated.

Providing explicit criteria around what constitutes the boundary of a solar PV device will ensure the integrity of the scheme is maintained and the regulatory burden on participants in interpreting requirements is reduced.

Emissions-intensive trade-exposed businesses and solar panel installers are encouraged to review the draft legislation and make a submission by the 5.00 pm on Friday, 14 December 2018.
