Revised ASIC guide for carbon market participants now available

The Australian Securities and Investments Commission (ASIC) has updated regulatory guidance for carbon market participants to reflect changes to the structure of Australia’s carbon market.

Do I need an AFS licence to participate in carbon markets? (Regulatory guide 236) provides advice on how current financial services laws apply to carbon market activities under the Emissions Reduction Fund and safeguard mechanism.

This will assist project participants, in particular aggregators, to:

  • determine if they require an Australian financial services (AFS) licence to participate in the carbon market, and
  • comply with financial services laws when participating in the carbon market

For more information see the ASIC website and refer to the Explanatory Statement to Corporations Amendment (Emissions Reduction Fund Participants) Regulation 2015.
