Issue of free carbon units

Under Part 7 of the Clean Energy Act 2011 (the Act) and Part 7 and Schedule 1 of the Clean Energy Regulations 2011 companies conducting emission intensive trade exposed (EITE) activities can apply to the Clean Energy Regulator for free carbon units under the Jobs and Competiveness Program.

An EITE company that meets the eligibility criteria is issued with a number of free carbon units. The EITE company can then determine how they use those carbon units. In accordance with subsection 198 (1) of the Act, the following information must be published on the Clean Energy Regulator website as soon as practicable after the free carbon units are issued to a person in accordance with the Jobs and Competitiveness Program:

  • The name of the person to whom the carbon units were issued
  • The total number of free carbon units issued to the person
  • The vintage year of the free carbon units issued to the person
  • Each activity that:
    • under the Jobs and Competitiveness Program, is taken to be an EITE activity, and
    • is an activity in respect of which the free carbon units were issued to the person.
